State Sponsored Business Investor 165 Visa

 

Important Note to Clients thinking of applying for Business Migration: 163/164/165

As of the 1st July all 163/164/165 South Australian Government State/Territory Sponsored visa applications will need to be lodged online. Immigration SA will no longer be accepting application in the old format. Please note if we do receive applications in the old format after the 1st July we will not be returning the documents back, you will be notified by email that your application will not be processed and you need to apply online.

 

Clients are required to complete the relevant online application (ie 163/164/165) accurately and truthfully and submit it electronically via the Immigration SA website. If you are unable to complete the application in one attempt, you can save the incomplete application and resume the process at a later date. In this instance, you will need to note down the reference ID number when you first log in, to enable future access to your unfinished application. After you have completed the on-line application form, you will be instructed on the Application Cover Sheet (Form A) to what documents need to be sent to Immigration SA. Please only send the documents that are outlined on Form A.

If you are a business person who is considering migrating to Australia under one of the Department of Immigration & Citizenship (DIAC) Business Skills migration categories, we invite you to consider making South Australia your new home for business and living.

 

South Australian sponsorship is available for all business migration categories including Business Owner, Senior Executive, Investor and Business Talent.  The South Australian Government values the contribution that business people make to our economy through increased exports, investment, job creation, and the introduction of new and improved technology.

 

Business Investor 165

This visa is available to business people who are owners or part owners of businesses or have direct involvement in eligible investment. This is a provisional visa which requires the holder to invest a designated amount (minimum of A$750,000) into South Australia Government Financing Authority bonds and also allows the holder to establish or conduct a business in South Australia. The visa is valid for a period of four years with the intention of the applicant able to apply for permanent residency at a later stage. Dependant on meeting the eligibility criteria, this visa offers the choice to apply for either Business Owner (Residence) visa sub-class 892 or Investor (Residence) visa sub-class 893.

Immigration South Australia – Sponsorship criteria

To obtain Sponsorship from the South Australian Government (Immigration SA), the Business Owner will need to demonstrate that they:

  • Are under 55 (unless exceptional circumstances apply- please see exceptional circumstances definition below)
  • Have an overall successful business career
  • Have the intention of investing at least $750,000 into the South Australian Government Financing Authority bonds
  • Have personal and business assets to the net value of $1,125,000 for the 2 fiscal years immediately before the application is made
Have the financial capacity to invest in South Australia and sufficient funds for settlement (please see chart below on what is considered sufficient funds for settlement)

For each additional dependent child a further $5,000 is required.

Exceptional circumstances definition - over 55

If the potential migrant is over 55, they will need to demonstrate that by sponsoring them they will be providing South Australia with exceptional economic benefit.

  • Significant increase in exports
  • A significant amount of new capital investment
  • The creation of new jobs
  • Introduction of new and improved technology
Helpful information for Business Migrants

Obtaining sponsorship from the South Australian Government is the first step towards gaining a visa to South Australia. To be successful in an application to DIAC, it is recommended that booklet 7 is either downloaded or obtained directly from DIAC. Sponsorship from the State Government does not guarantee success in a migration application with DIAC.

Business Migration Support Services

The South Australian Government has established the Business Migrant Support Services to help business migrants settle into South Australia. The Business Migrant Support Service is available to business migrants sponsored by the South Australian Government (Immigration SA). 

Services include:

  • Exploratory Visit Support (*pre-application stage)
  • Relocation Service
  • Business SA business facilitation program (*funded by the State Government)
  • Permanent residency requirements information sessions
  • Open Days

After arrival in South Australia

It is a requirement that you contact Immigration SA in writing or in person within two months after you have formally settled in South Australia at a temporary or permanent residence; and you have registered a business in South Australia. You are required to provide details of your current residential address and your business name and location if applicable. Please ensure that you clearly identify yourself by providing a copy of your current passport photo page with your updated contact details.

 

It is also a requirement that you inform Immigration SA of any further changes to your residential and business details while you are the holder of a subclass 165 visa.

 

Should you conduct a business different from what is proposed in your original business plan due to the change of business circumstance after your arrival and settlement, you are required to notify Immigration SA in writing. Please note it is not a requirement for visa holders to submit an updated business plan but formal notification of the change is required in writing.

 

Sponsorship from the South Australian Government is not transferable to other States or Territories in Australia.

Applying for State Sponsorship

To apply for sponsorship from Immigration SA, please ensure that the following requirements are undertaken:

  • Conduct a self assessment against the Department of Immigration and Citizenship Requirements
  • Complete the online sponsorship application
  • Gather all required and supporting documents as outlined in form A., ensuring they are complete and form A is attached to the front
  • Send all required and supporting documents to Immigration SA - Business Migration by mail:

All documentation submitted to Immigration SA is kept confidential. Personal information will not be released unless the applicant gives his/her consent.

Processing time

The State Government sponsorship application is free of charge and takes approximately four weeks to process. Processing of your application will only commence when the on-line application has been submitted electronically AND all the supporting documentation as out lined in Form A have been received by Immigration SA.

 

Please note that where the supporting documentation to an application is complete and clearly shows that the applicant meets all of the relevant requirements, application is less likely to be delayed in processing. This timeframe is subject to change dependant on the quantity of applications being processed.

Using a Migration Agent

When utilising the services of a Migration agent, it is in your best interest to ensure that the Agent is registered with the Migration Agents Registration Authority (MARA). To check if your agent is registered, please log on to http://www.themara.com.au

 

Registered migration agents are bound by the Migration Agents Code of Conduct and generally charge for their services. The MARA investigates complaints against registered migration agents and may take disciplinary action against them. If you have a concern about a registered migration agent, you should contact the MARA. You can also download a copy of the complaint form from the MARA's website. If you make a complaint against a migration agent, the complaint should be made to the MARA in writing. If you have difficulty with written English, you may prefer to attach a letter, in your own language. The MARA cannot accept a complaint made via the telephone.

English Tuition

If you or any dependants aged 18 years and over are unable to demonstrate to DIAC that you have a functional level of English, you will be required to pay a second visa application charge.
